Terms of Service

These Terms of Service ("Terms") are an agreement between you and Blue Blip Tech LLC, McDonough, Georgia ("we", "us"), and govern your use of NotaryOps (the "Service"). If you use the Service on behalf of an organization, you agree to these Terms for that organization and confirm you have authority to do so. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service

NotaryOps is software for keeping a digital notary journal: recording notarizations, signers, identification, signatures and fees, verifying identity documents, and exporting journals. Organizations can add notaries who keep their journals under the organization's account.

2. You are responsible for your notarial acts

NotaryOps is a record-keeping tool. It does not provide legal advice, does not perform notarizations and is not a substitute for your judgment as a notary. You are solely responsible for complying with the laws, regulations and rules that apply to your commission, including what a journal must contain, how identity must be established, how long records must be kept, and whether an electronic journal is permitted where you are commissioned. You are responsible for obtaining any consent required from signers before photographing their identification or verifying their identity with the Service.

Identity verification results come from a third-party provider and may be wrong. A verification result does not relieve you of your duty to identify signers as the law requires.

3. Accounts

  • You must be at least 18 and provide accurate information when you register.
  • Keep your password and access to your email secure. You are responsible for activity under your account, and you must tell us promptly at hello@notaryops.app if you suspect unauthorized access.
  • Each notary added by an organization must use their own sign-in. Accounts may not be shared.
  • Organization administrators are responsible for the notaries they add, deactivate or remove, and for the organization's use of the Service.

4. Free trial and subscriptions

  • New accounts start with a 3-day free trial. No payment method is needed to sign up. During the trial, an organization can add only 1 notary. To keep creating journal entries after the trial, you must subscribe.
  • Subscriptions are billed monthly in advance through Stripe at the prices shown when you subscribe. The individual plan is for one notary. The organization plan includes 5 active notaries (the organization's administrator is not counted), and each additional active notary is billed monthly on the same subscription, prorated when notaries are added or removed during a billing period.
  • Subscriptions renew automatically each month until cancelled. You can cancel at any time in your account settings, and access continues until the end of the period you have paid for. You can renew a cancelled subscription before it ends.
  • Except where the law requires otherwise, fees are non-refundable, including for partial months.
  • We may change prices with at least 30 days' notice. Changes apply from your next billing period.
  • If a payment fails, we may suspend the creation of new entries until it is resolved. Your existing journals remain available to you.
  • Prices do not include taxes, which are added where required.

5. Your data

You keep ownership of the journal information you enter. You give us permission to store, process, back up and display it, and to share it with our service providers, only as needed to provide the Service and as described in our Privacy Policy. You confirm that you have the right to enter the information you record, including information about signers.

Journal entries cannot be edited or deleted once saved. Mistakes are fixed by adding a correction. Entries are kept for 10 years from the notarization date, as described in the Privacy Policy, and you can export your journal to PDF at any time while you have access to your account.

6. Acceptable use

You agree not to:

  • use the Service for anything unlawful or fraudulent, or to record false information;
  • access accounts, journals or data that are not yours, or try to get around security, sign-in or usage limits;
  • interfere with or overload the Service, or probe or test its vulnerabilities without our written permission;
  • copy, resell or reverse engineer the Service, except as the law allows; or
  • upload malicious code or content that infringes anyone's rights.

7. Third-party services

The Service relies on third parties, including Stripe for payments, MailerSend for email and Didit for identity verification. Your use of those features may also be subject to their terms. We are not responsible for third-party services, but we choose our providers carefully and require them to protect your information.

8. Suspension and termination

You may stop using the Service and cancel your subscription at any time. We may suspend or close an account that breaches these Terms, creates a security risk or is required by law to be closed. We will give notice where reasonable. When an account is closed, sign-in is removed, any active subscription is cancelled, and journals are kept for the retention period described above. Sections 2, 5, 9, 10, 11 and 12 survive termination.

9. Disclaimers

We work to keep the Service available, accurate and secure, but it is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that identity verification results will be correct, or that using the Service satisfies the requirements of any particular jurisdiction.

10. Limitation of liability

To the fullest extent the law allows, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

11. Indemnification

You agree to defend and indemnify Blue Blip Tech LLC against claims, losses and expenses, including reasonable attorneys' fees, arising from your notarial acts, the information you record, your breach of these Terms or your violation of any law or the rights of others.

12. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Henry County, Georgia, or the federal court for the district that includes it, and both parties consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify account holders by email or in the app at least 30 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.

14. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger or sale of our business.
